Terms of Use

Effective date: 1 November 2026

These Terms of Use ("Terms") are an agreement between you and PlaySocial Labs Private Limited ("PlaySocial Labs", "we", "us"), the operator of the Kinmo mobile application and related services (the "App"). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old to use the App. If you are under the age of majority where you live, you may use the App only with the permission and supervision of a parent or guardian, who agrees to these Terms on your behalf.

2. The App

Kinmo lets you play motion-controlled games using your device's camera and, optionally, a connected screen such as a television. We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the App on devices you own or control, for personal, non-commercial entertainment, in line with these Terms and the rules of the app store you downloaded it from.

3. Physical activity and safety

Kinmo involves physical movement such as jumping, dodging, reaching and running in place. You play at your own risk.
  • Clear enough space around you. Move furniture, pets, breakable objects and other people out of the play area.
  • Make sure the floor is not slippery, and wear suitable footwear or play barefoot on a safe surface.
  • Keep a safe distance from your TV, walls, windows and the device running the App. Secure your phone so it cannot fall.
  • Take breaks, stay hydrated and stop immediately if you feel pain, dizziness, shortness of breath or discomfort.
  • Consult a doctor before playing if you are pregnant, have a heart, respiratory, joint or other medical condition, or have experienced seizures. A small number of people may experience seizures when exposed to flashing lights or patterns.
  • Supervise younger players at all times.

The App is for entertainment only. It is not a medical, fitness or rehabilitation device and does not provide medical advice.

4. Camera and privacy

The App uses your camera to detect movement. Camera video is processed on your device and is not uploaded or stored by us. Our Privacy Policy explains how we handle information and forms part of these Terms.

5. Player names and leaderboards

You are responsible for the nicknames and player names you create. Do not use names that are offensive, hateful, sexually explicit, impersonate others, infringe anyone's rights or include personal information. We may remove or change names and reset scores that break these Terms or that result from cheating, exploits or manipulation.

6. Acceptable use

You agree not to:

  • copy, modify, distribute, sell or lease any part of the App;
  • reverse engineer, decompile or attempt to extract the source code or models of the App, except where the law expressly allows it;
  • use cheats, bots, automation or exploits, or interfere with the App's security or operation;
  • use the App for any unlawful purpose or in a way that could harm you, other people or property.

7. Intellectual property

The App, including its games, characters, artwork, music, software and the Kinmo name and logo, is owned by PlaySocial Labs or its licensors and is protected by intellectual property laws. Except for the licence in section 2, no rights are granted to you.

8. Notifications and updates

If you allow notifications, we may send you messages about the App, such as new games. You can turn them off in your device settings. We may update, change or discontinue features or games at any time. Some updates may be required to keep using the App.

9. Third-party services

The App may work with third-party devices and services, such as screen casting, smart TVs and app stores. We are not responsible for third-party products or services, and your use of them is governed by their own terms.

10. Disclaimers

The App is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. Motion tracking may not work perfectly on every device, in every lighting condition or for every user, and we do not guarantee that the App will be uninterrupted or error-free.

11. Limitation of liability

To the fullest extent permitted by law, PlaySocial Labs and its directors, employees and partners will not be liable for any indirect, incidental, special or consequential damages, or for any injury, loss or damage to property arising from your use of the App, including injuries from physical activity. Our total liability for any claim relating to the App will not exceed the greater of the amount you paid us for the App in the 12 months before the claim, or INR 1,000. Nothing in these Terms limits liability that cannot be limited under applicable law, including your statutory rights as a consumer.

12. Indemnity

You agree to indemnify PlaySocial Labs against claims, losses and expenses arising from your breach of these Terms or misuse of the App, to the extent permitted by law.

13. Termination

You may stop using the App at any time by uninstalling it. We may suspend or end your access if you breach these Terms. Sections 7 and 10 to 15 survive termination.

14. Apple and Google

These Terms are between you and PlaySocial Labs only, not Apple Inc. or Google LLC. Apple and Google are not responsible for the App, its maintenance or support, or any claims relating to it. If you downloaded the App from the Apple App Store, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. In the event of any failure of the App to conform to an applicable warranty, you may notify Apple for a refund of the purchase price, if any. Your use of the App must also comply with the applicable app store terms of service.

15. Governing law and disputes

These Terms are governed by the laws of India. Subject to any mandatory consumer protection laws in your country of residence, the courts of Bengaluru, Karnataka, India have exclusive jurisdiction over any dispute arising from these Terms or the App. Before starting any proceedings, please contact us so we can try to resolve the issue informally.

16. Changes to these Terms

We may update these Terms from time to time. We will post the updated version here with a new effective date and, for material changes, notify you in the App. Continuing to use the App after changes take effect means you accept the updated Terms.
